{"id":621104,"date":"2018-01-20T03:18:47","date_gmt":"2018-01-20T03:18:47","guid":{"rendered":"http:\/\/juniorminingnews.com\/?p=621104"},"modified":"2018-01-20T03:18:47","modified_gmt":"2018-01-20T03:18:47","slug":"crystallex-requests-new-hearing-in-lawsuit-against-venezuela-2","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=621104","title":{"rendered":"Crystallex requests new hearing in lawsuit against Venezuela"},"content":{"rendered":"<p><span style=\"font-style:italic;font-size:16px\">By  <a class=\"colorbox\" href=\"http:\/\/juniormininganalyst.com\/crystallex-requests-new-hearing-in-lawsuit-against-venezuela\/\">analyst<\/a><\/span>  <\/p>\n<p><span>By  <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/crystallex-requests-new-hearing-lawsuit-venezuela\/\">Valentina Ruiz Leotaud<\/a><\/span>  <\/p>\n<p>Following the <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/web\/u-s-court-rules-miner-crystallex-venezuela-dispute\/\" rel=\"noopener\" target=\"_blank\">dismissal<\/a> by a U.S. court of Crystallex&#8217;s lawsuit against asset transfers by <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/oil-rich-venezuela-gas\/\" rel=\"noopener\" target=\"_blank\">Venezuelan-owned refiner Citgo<\/a>, the Canadian company announced that it has requested a new hearing.<\/p>\n<p>According to <a class=\"colorbox\" href=\"http:\/\/www.bancaynegocios.com\/crystallex-solicita-nueva-audiencia-en-demanda-contra-pdvsa\/\" rel=\"noopener\" target=\"_blank\">Venezuelan<\/a> <a class=\"colorbox\" href=\"http:\/\/www.eluniversal.com\/noticias\/economia\/crystallex-denuncia-que-tribunal-eeuu-paso-por-alto-demanda_684706\" rel=\"noopener\" target=\"_blank\">media<\/a>, the miner filed the new request before the 3rd U.S. Circuit Court of Appeals earlier this week. The company alleges that the South American country is performing \u201cfraudulent transfers\u201d to avoid paying what it owes after the 2008 nationalization of Crystallex&#8217;s assets.<\/p>\n<p>In detail, the Toronto-based corporation is <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/web\/crystallex-venezuela-agree-settle-1-2-billion-mine-dispute\/\" rel=\"noopener\" target=\"_blank\">seeking to collect $1.2 billion<\/a> plus interest awarded in 2016 by a World Bank tribunal against <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/following-detention-journalist-publishes-controversial-story-venezuelas-mining-arc\/\" rel=\"noopener\" target=\"_blank\">Venezuela<\/a>. But the Nicol\u00e1s Maduro government has refused to pay and, according to Crystallex, state-owned Citgo performed a series of \u201cfraudulent\u201d operations in 2015 and 2016 to avoid paying its debt.<\/p>\n<p>Among those transactions, Crystallex cites the payment of dividends from PDV Holding to PDVSA for $2.2 billion and the issuance of 49.9% of Citgo&#8217;s shares to secure a loan granted by Russian giant Rosneft in 2016.<\/p>\n<p><a class=\"colorbox\" href=\"https:\/\/www.el-carabobeno.com\/crystallex-solicita-nueva-audiencia-demanda-pdvsa-eeuu\/\" rel=\"noopener\" target=\"_blank\">Local<\/a> <a class=\"colorbox\" href=\"http:\/\/www.el-nacional.com\/noticias\/petroleo\/crystallex-solicita-nueva-audiencia-demanda-contra-pdvsa_219485\" rel=\"noopener\" target=\"_blank\">newspapers<\/a> state that, in the new submission, the gold miner says that Venezuela is using such mechanisms to hide the money it owes, that it has to be forced to pay and that the court that rejected the suit omitted or misunderstood the U.S. law regarding fraudulent transfers of funds.<\/p>\n<p>It was just a couple of weeks ago, on January 3, 2018, when the 3rd U.S. Circuit Court of Appeals <a class=\"colorbox\" href=\"http:\/\/www2.ca3.uscourts.gov\/opinarch\/164012p.pdf\" rel=\"noopener\" target=\"_blank\">dismissed Crystallex&#8217;s suit<\/a> because it targeted a Delaware-incorporated subsidiary of state-owned oil company PDVSA which in turn owns Citgo. The court said that Crystallex&#8217;s claim is against Venezuela rather than Citgo.
