{"id":562206,"date":"2017-10-05T16:25:55","date_gmt":"2017-10-05T16:25:55","guid":{"rendered":"http:\/\/juniorminingnews.com\/?p=562206"},"modified":"2017-10-05T16:25:55","modified_gmt":"2017-10-05T16:25:55","slug":"barrick-to-pay-20-million-to-settle-pascua-lama-related-arbitration-case-2","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=562206","title":{"rendered":"Barrick to pay $20 million to settle Pascua-Lama-related arbitration case"},"content":{"rendered":"<p><span style=\"font-style:italic;font-size:16px\">By  <a class=\"colorbox\" href=\"http:\/\/juniormininganalyst.com\/barrick-to-pay-20-million-to-settle-pascua-lama-related-arbitration-case\/\">analyst<\/a><\/span>  <\/p>\n<p><span>By  <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/barrick-pay-20-million-settle-pascua-lama-related-arbitration-case\/\">Cecilia Jamasmie<\/a><\/span>  <\/p>\n<p>Canada&#8217;s Barrick Gold (TSX, NYSE:ABX) has agreed to pay $20 million to a Chilean group in order to settle an arbitration case against the company filed last year after the miner, the world&#8217;s No.1 gold producer by market value, halted payments settled in 2005.<\/p>\n<p>The lawsuit, brought by the irrigation association of Chile&#8217;s Huasco river, followed Barrick&#8217;s decision to stop paying $3 million a year to complete a $60 million-over-20-years agreed instalment, <a class=\"colorbox\" href=\"http:\/\/www.mch.cl\/2017\/10\/04\/barrick-pagara-us20-millones-regantes-cerrar-arbitraje\/\" target=\"_blank\">El Mercurio reported<\/a> (in Spanish).<\/p>\n<p>Arbitration case against the company was filed last year after the miner halted payments due to a local group.<\/p>\n<p>That fee was part of a legal obligation to compensate local communities affected by a project. In this case, the mothballed Pascua Lama gold, silver and copper project straddling the border between Chile and Argentina.<\/p>\n<p>The giant project in the Andes has been <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/barrick-has-had-enough-stops-construction-of-pascua-lama-mulls-stake-sale-89887\/\" target=\"_blank\">shuttered since 2013<\/a>, when a court ordered the company to halt construction <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/chile-to-fine-barrick-over-ten-new-environmental-violations\/\" target=\"_blank\">over environmental concerns<\/a>. Later that year, Barrick shelved the project citing massive cost overruns and nose-diving metal prices.<\/p>\n<p>The company had said payments to the Huasco community were suspended as a result of the indefinite pause in the development of Pascua-Lama. The beneficiaries of those payments, as expected, disagreed.<\/p>\n<p>A settlement was finally reached over the weekend, with Barrick agreeing to pay $6 million within 15 days of the singing of agreement. The company also committed to pay a further $ 14.1 million in nine annual instalments.<\/p>\n<p>Should Barrick resume operations in the Pascua side of the project (the Chilean portion), the figure will go up to $14.8 million, payable in five annual instalments.<\/p>\n<p>Last year, the gold miner <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/barrick-announces-drastic-revision-of-pascua-lama-may-add-partner\/\" target=\"_blank\">began a \u201cdrastic revision\u201d<\/a> of Pascua Lama and agreed to pay $140 million to resolve a <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/us-judge-rules-barrick-gold-must-face-group-lawsuit-over-pascua-lama-mine\/\" target=\"_blank\">US class-action lawsuit<\/a> that accused it of distorting facts related to the controversial project.<\/p>\n<p>In April, it <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/barrick-confirms-selling-half-of-veladero-pascua-lama-to-shandong-gold\/\" target=\"_blank\">sold a 50% stake in its Veladero<\/a> mine in Argentina to Shandong Gold Group in a transaction worth $960 million.
