{"id":482722,"date":"2017-05-04T00:36:27","date_gmt":"2017-05-04T00:36:27","guid":{"rendered":"http:\/\/juniorminingnews.com\/?p=482722"},"modified":"2017-05-04T00:36:27","modified_gmt":"2017-05-04T00:36:27","slug":"peruvian-supreme-court-rules-against-newmont-2","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=482722","title":{"rendered":"Peruvian Supreme Court rules against Newmont"},"content":{"rendered":"<p><span style=\"font-style:italic;font-size:16px\">By  <a class=\"colorbox\" href=\"http:\/\/juniormininganalyst.com\/peruvian-supreme-court-rules-against-newmont\/\">analyst<\/a><\/span>  <\/p>\n<p><span>By  <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/peruvian-supreme-court-rules-newmont\/\">Andrew Topf<\/a><\/span>  <\/p>\n<p>The Supreme Court of Peru has ruled in favour of a farmer that Newmont Mining (NYSE:NEM) claimed was illegally occupying land it wanted to develop into the Conga mine.<\/p>\n<p>The U.S.-based gold miner appealed a decision by a lower court in 2014 that ruled in favour of potato farmer M\u00e1xima Acu\u00f1a.<\/p>\n<p>Community opposition to the $5 billion copper and gold project forced Newmont to <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/community-opposition-forces-newmont-abandon-conga-project-peru\/\">walk away from it last year<\/a>.<\/p>\n<p>Acu\u00f1a, who has been at the forefront of the opposition against the Conga project since it was first proposed in 2010, was awarded the Goldman Environmental Prize.<\/p>\n<p>Newmont decided to <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/peru-declares-state-of-emergency-over-cajamarca-gold-mine-protests\/\" target=\"_blank\">halt construction work <\/a>at the project in November 2011, after violent protests led by governor Gregorio Santos forced the country&#8217;s government to declare a state of emergency.<\/p>\n<p>Minera Yanacocha, one of the two local companies working with Newmont on the now mothballed project, <a class=\"colorbox\" href=\"http:\/\/www.scribd.com\/doc\/76683916\/Participacion-Ciudadana-EIA-Proyecto-Conga\" target=\"_blank\">tried hard to win local support<\/a>, but was <a class=\"colorbox\" href=\"http:\/\/www.mining.com\/fresh-protests-threaten-newmont-conga-mine-in-peru-65256\/\" target=\"_blank\">unable to secure it<\/a>.<\/p>\n<p>\u201cI feel happy and relieved that here in the capital [the court] has also provided justice,\u201d Acu\u00f1a said after the Supreme Court decision. Reuters <a class=\"colorbox\" href=\"http:\/\/www.reuters.com\/article\/peru-mining-newmont-idUSL1N1I51GN\">reported<\/a> Acu\u00f1a saying her home was destroyed during the mine&#8217;s construction.
