{"id":1198501,"date":"2020-07-28T16:56:55","date_gmt":"2020-07-28T21:56:55","guid":{"rendered":"https:\/\/www.mining.com\/?p=1031110"},"modified":"2020-07-28T16:56:55","modified_gmt":"2020-07-28T21:56:55","slug":"rio-tinto-in-discussions-with-sfo-over-simandou-probe","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1198501","title":{"rendered":"Rio Tinto in discussions with SFO over Simandou probe"},"content":{"rendered":"<p>Rio Tinto is in discussions with the UK\u2019s Serious Fraud Office (SFO) about a possible deal under which the miner would avoid prosecution on bribery allegations over dealings for the giant Simandou iron mine in Guinea, the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.ft.com\/\" ><em>Financial Times reported.<\/em> <\/a><\/p>\n<p>At two billion tonnes of iron ore with some of the highest grades in the industry, Simandou is one of the<a rel=\"noreferrer noopener\" href=\"https:\/\/www.mining.com\/china-backed-jv-to-develop-giant-simandou-north-iron-ore-deposit-in-guinea\/\" > world\u2019s biggest and richest reserves<\/a> of the steelmaking material, but it has a controversial&nbsp;past.<\/p>\n<p>The Office is reportedly seeking a deferred prosecution agreement (DPA) over a payment Rio Tinto made that came under scrutiny in 2016.  The world\u2019s no. 2 miner &nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.mining.com\/heads-roll-at-rio-tinto-over-simandou-probe-davies-valentine-fired\/\" >fired two senior managers<\/a>&nbsp;over a questionable $10.5 million payment made to a consultant who helped the company secure the two blocks and alerted authorities, including the US Department of Justice and the&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.mining.com\/uk-serious-fraud-office-launches-probe-rio-tinto-simandou\/\" >UK\u2019s Serious Fraud Office<\/a>. <\/p>\n<figure class=\"wp-block-pullquote alignright\">\n<blockquote>\n<p>Emails showed senior Rio executives discussing the payment to Combret and his \u201ccloseness\u201d to Guinea\u2019s President Alpha Cond\u00e9<\/p>\n<\/blockquote>\n<\/figure>\n<p>Rio Tinto&nbsp;had previously held rights to develop all four blocks of Simandou before being stripped of the rights to blocks 1 and 2 in 2008. <\/p>\n<p>Emails from 2011 that were posted online showed senior Rio executives discussing the payment to Combret. <\/p>\n<p>The messages indicate that Combret helped the company to secure its claim to half of Simandou with a $700 million payment to the then new government of  Alpha Cond\u00e9.<\/p>\n<p> For negotiations to begin under a DPA, a company must agree to terms that include paying a fine and co-operating with future prosecutions.<\/p>\n<p>According to information published by the SFO after a freedom of information request, 66 individuals were interviewed under caution in relation to DPAs between 2014 and April 2020 and 11 charged, but none have been convicted, the <em><a href=\"https:\/\/www.ft.com\/\"  rel=\"noreferrer noopener\">Financial Times reported<\/a><\/em>.
