{"id":1197989,"date":"2020-07-26T13:29:03","date_gmt":"2020-07-26T18:29:03","guid":{"rendered":"https:\/\/www.mining.com\/?p=1030891"},"modified":"2020-07-26T13:29:03","modified_gmt":"2020-07-26T18:29:03","slug":"venezuelas-interim-government-faces-a-number-of-challenges-in-the-crystallex-dispute","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1197989","title":{"rendered":"Venezuela\u2019s interim government faces a number of challenges in the Crystallex dispute"},"content":{"rendered":"<p>A decision regarding Canadian miner Crystallex\u2019s request to sell the shares of PDV Holdings, the parent company of refiner <a href=\"https:\/\/www.mining.com\/web\/venezuela-faces-loss-of-citgo-to-canadas-crystallex-international\/\"  rel=\"noreferrer noopener\">Citgo Petroleum Corp<\/a>., which is owned by Venezuela, was expected by the end of July. Now it is likely to be made sometime in August.\u00a0<\/p>\n<p>This, after US Justice Department lawyers asked District Judge Leonard Stark in Delaware, where Citgo\u2019s parent is incorporated, not to bless Crystallex\u2019s request to sell the shares until US regulators finish examining the deal.&nbsp;<\/p>\n<p>Crystallex is aiming at collecting a $1.4-billion-award in compensation following a <a href=\"https:\/\/www.mining.com\/latest-episode-crystallex-venezuela-saga\/\"  rel=\"noreferrer noopener\">decade-long dispute<\/a> over Venezuela\u2019s 2008 nationalization of its gold mine in the southern Bol\u00edvar state. The amount is comprised of $1.2 billion, plus $200 million of interest awarded by a World Bank arbitration tribunal in 2016.<\/p>\n<p>But according to the Justice Department lawyers\u2019 filing, approving the share sale would harm US foreign policy and national-security interests in <a href=\"https:\/\/www.mining.com\/venezuela-allows-gold-mining-in-river-basins\/\"  rel=\"noreferrer noopener\">Venezuela<\/a>.\u00a0<\/p>\n<p>In a similar tone, Elliott Abrams, President Donald Trump\u2019s special representative to Venezuela, sent a letter to the Attorney General and the Justice Department stating that Crystallex cannot sell the shares without a license from the US Office of Foreign Asset Control. <\/p>\n<p>These moves back arguments by lawyers for Venezuelan interim president Juan Guaid\u00f3, whose team wants to honour the debts with Crystallex but opposes the sale of Citgo\u2019s assets to protect one of the country\u2019s main sources of hard currency.<\/p>\n<p>However, according to economist Francisco Rodr\u00edguez, founder of the think-tank Oil for Venezuela, the Guaid\u00f3 government has a steep hill to climb.<\/p>\n<figure class=\"wp-block-embed-twitter alignright wp-block-embed is-type-rich is-provider-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\">1. Abro hilo explicativo.<\/p>\n<p>&mdash; Francisco Rodr\u00edguez (@frrodriguezc) <a href=\"https:\/\/twitter.com\/frrodriguezc\/status\/1281983535595888641?ref_src=twsrc%5Etfw\">July 11, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><br \/>\n<\/figure>\n<p>Once it was recognized by the US and other 50 states as the Venezuelan legitimate government, the new administration had to prove that there is a separation between the state and Citgo\u2019s management.<\/p>\n<p>In a series of explanatory tweets, Rodr\u00edguez said that the Guaid\u00f3 government\u2019s ability to prove this separation was severely affected when Venezuela\u2019s National Assembly named Citgo\u2019s board of directors on February 13, 2019. This was supposed to be done by Citgo Holding\u2019s board of directors.<\/p>\n<p>\u201cPresident Guaid\u00f3 published a <a rel=\"noreferrer noopener\" href=\"https:\/\/twitter.com\/jguaido\/status\/1095740413820977155\" >tweet<\/a> that same day announcing the appointment of Citgo\u2019s new board of directors. He used a format that was very similar to the announcements made by [Nicol\u00e1s] Maduro which were used months ago by Crystallex as evidence against Venezuela,\u201d\u00a0Rodr\u00edguez said. \u201cNot surprisingly, just a few weeks after, Crystallex filed a legal brief arguing that violations to [the principle of] corporate veil were ongoing under Guaid\u00f3 and that, therefore, the court should reject any argument related to the way the company is being managed.\u201d<\/p>\n<p>The economist argued that the importance of these mistakes should not be overlooked. On top of having named the board of directors, later on, in July 2019 and June 2020, Citgo Holding and Citgo Petroleum issued, without the approval of Venezuela\u2019s National Assembly, debt bonds whose warranties were the country\u2019s assets.&nbsp;<\/p>\n<p>These issuances, which were made by officials named by the interim government of Juan Guaid\u00f3, are now being used by the creditors of the PDVSA 2020 bond to contradict Venezuela\u2019s attempt to invalidate the warranty of these bonds for not having the parliament\u2019s approval. The PDVSA 2020 is a collateralized bond issued by state oil company Petr\u00f3leos de Venezuela S.A., owner of PDV Holdings.<\/p>\n<figure class=\"wp-block-pullquote alignright\">\n<blockquote>\n<p>Economist Francisco Rodr\u00edguez said Venezuelans should demand answers to certain questions related to this case<\/p>\n<\/blockquote>\n<\/figure>\n<p>\u201cIn the face of the systematic repetition of these types of mistakes that endanger the strategy of safeguarding the country\u2019s assets, Venezuelans should demand answers to certain questions,\u201d Francisco Rodr\u00edguez said. \u201cThese questions should be part of the regular process of leading a modern democracy. There shouldn\u2019t be any resistance from the interim government to provide a clear explanation of these issues.\u201d<\/p>\n<p>In the economist\u2019s view, analyzing these errors would not only make the new government more transparent, which would <a href=\"https:\/\/www.mining.com\/web\/venezuelas-rival-presidents-prepare-to-battle-over-gold\/\"  rel=\"noreferrer noopener\">separate it<\/a> from the \u201c<a href=\"https:\/\/www.mining.com\/web\/iran-hauls-gold-bars-out-of-venezuelas-almost-empty-vaults\/\"  rel=\"noreferrer noopener\">obscure practices<\/a> of [Maduro\u2019s] dictatorship,\u201d but it may also help find solutions to the complex legal position in which Venezuela finds itself.\u00a0<\/p>\n<p>Thus, he proposed that Guaid\u00f3 and his team dig deep and respond who were the legal advisors that recommended the \u201cunusual appointment\u201d of Citgo\u2019s board of directors.
