{"id":1193611,"date":"2020-07-02T13:33:01","date_gmt":"2020-07-02T18:33:01","guid":{"rendered":"https:\/\/resourceworld.com\/?p=58717"},"modified":"2020-07-02T15:47:19","modified_gmt":"2020-07-02T20:47:19","slug":"supreme-court-dismisses-first-nations-challenge-against-trans-mountain-pipeline","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1193611","title":{"rendered":"Supreme Court dismisses First Nations&rsquo; challenge against Trans Mountain Pipeline"},"content":{"rendered":"<p>Today (July 2) the Supreme Court of Canada dismissed the Squamish Nation, Tsleil-Waututh Nation, and Coldwater Band\u2019s application for leave to appeal the February 4, 2020 Federal Court of Appeal decision Coldwater First Nation v. Canada (Coldwater decision).<\/p>\n<p>As the challenge was in Canada\u2019s Supreme Court, the decision marks the end of the groups\u2019 legal opposition. The February 4, 2020 decision determined that that cabinet\u2019s approval of the pipeline project in June 2019 was reasonable under law.<\/p>\n<p>Ian Anderson, President and CEO of Trans Mountain Corp., commented: \u201cWe are pleased with the Court\u2019s decision to dismiss these applications and uphold the Federal Court of Appeal\u2019s decision. Following the Federal Government\u2019s second approval of the Trans Mountain Expansion Project and many years of consultation and regulatory reviews, we are pleased to continue building this nationally important project.\u201d<\/p>\n<p>The\u00a0Trans Mountain Expansion\u00a0(TMX)\u00a0project\u00a0runs from Edmonton, Alberta, to the Westridge Marine Terminal and the Chevron refinery (now Parkland\u00a0Refining\u00a0(B.C.) Ltd.) in Burnaby, British Columbia. It will twin an existing oil\u00a0pipeline\u00a0that was built in 1953.\u00a0This will increase the pipeline\u2019s capacity to\u00a0890,000 barrels per day from 300,000 barrels.<\/p>\n<p>The project also\u00a0expands the Westridge Marine Terminal\u00a0by adding two berths. It increases the number of tankers that the terminal can handle per month to 34 from five. It will follow existing rights of way for 89% of its 1,147-kilometre length. Construction is expected to be completed mid to late 2022.<\/p>\n<p>The Government of Canada has a 100% interest in the existing Trans Mountain Pipeline and the expansion project.<\/p>\n<p>As of September 30, 2019, Trans Mountain Corporation (TMC) and its contractors have\u00a0hired more than 2,200 people for the project, including Indigenous, local and regional employees. This workforce includes heavy equipment operators, trades people, environment and safety compliance roles, engineers, construction managers and administration staff.<\/p>\n<p>At peak construction, there are expected to be\u00a05,500 people employed in the construction\u00a0of the pipeline on sites in Alberta and British Columbia.<\/p>\n<p>TMX will also create economic benefits for many Indigenous communities, such as through contracting, financial compensation, and employment and training opportunities.<\/p>\n<p>\u201cThe Union of BC Indian Chiefs (UBCIC) strongly disagrees with the Supreme Court of Canada\u2019s decision to dismiss this application and deny Indigenous Nations their right to free, prior, and informed consent,\u201d stated Grand Chief Stewart Phillip, President of UBCIC. \u201cThe Crown has failed to adequately consult with Indigenous peoples on the TMX project, and the court has today failed to hold the Crown accountable to its constitutional
