{"id":1192541,"date":"2020-06-26T14:18:14","date_gmt":"2020-06-26T19:18:14","guid":{"rendered":"https:\/\/www.mining.com\/?p=1028163"},"modified":"2020-06-26T14:18:14","modified_gmt":"2020-06-26T19:18:14","slug":"legal-frameworks-need-improving-for-environmental-social-assessments-on-mines","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1192541","title":{"rendered":"Legal frameworks need improving for environmental, social assessments on mines"},"content":{"rendered":"<p>The Intergovernmental Forum on Mining, Minerals, Metals and Sustainable Development (IGF) has released its newest report. <\/p>\n<p><em>Guidance for Governments: Improving Legal Frameworks for Environmental and Social Impact Assessment and Management<\/em> provides IGF member states with a summary of good international practice in legal frameworks for ESIA and related management plans for large-scale mines. <\/p>\n<p>Examples, strategies, and tools are included to aid in evaluating and improving legal frameworks and environmental and social aspects of resource governance.<\/p>\n<p>A modern legislative regime draws clear lines of responsibility and accountability and establishes a foundation of good governance that leads to sustainable development benefits over the full life cycle of a mine, from the early days of exploration through to post-mining transition, IGF says. <\/p>\n<p>A key recommendation is that Governments should adopt a comprehensive<br \/>legal framework for environmental and social impact assessment and management of the mining sector to ensure that it protects the<br \/>environment and optimizes opportunities to advance sustainable development. <\/p>\n<p>\u201cThis report fills a gap in the literature on law and policy frameworks for environmental and social impact assessments [ESIA] and related management plans,\u201d says Cl\u00e9mence Nar\u00e9, IGF\u2019s outreach manager and law advisor.<\/p>\n<figure class=\"wp-block-pullquote alignright\">\n<blockquote>\n<p>ESIA and related management plans are critical to minimize the potential negative environmental and social impacts and optimize the benefits from large-scale mines<\/p>\n<\/blockquote>\n<\/figure>\n<p>\u201cWe surveyed global best practices and identified illustrative examples, strategies, and tools to help governments improve their governance and management of the mining sector\u2019s environmental and social impacts,\u201d Nar\u00e9 says.<\/p>\n<p>ESIA and related management plans are critical to minimize the potential negative environmental and social impacts and optimize the benefits from large-scale mines.<\/p>\n<p>\u201cToo often, mining activity ramps up before the environmental and social impacts are properly considered,\u201d Nar\u00e9 says. \u201cFor instance, in some cases, mines without adequate closure plans or related financial guarantees have been abandoned, leaving governments and communities with the heavy burden of managing the site.\u201d<\/p>\n<p>The publication is the fourth in IGF\u2019s Guidance for Governments series.
