{"id":1157354,"date":"2019-12-27T11:43:08","date_gmt":"2019-12-27T17:43:08","guid":{"rendered":"https:\/\/www.mining.com\/?p=1010097"},"modified":"2019-12-27T11:43:08","modified_gmt":"2019-12-27T17:43:08","slug":"japanese-chilean-miner-files-legal-complaint-against-chilean-senator","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1157354","title":{"rendered":"Japanese-Chilean miner files legal complaint against Chilean senator"},"content":{"rendered":"<p>Atacama Kozan, a Chilean-Japanese mining company that operates its namesake copper mine in the Copiap\u00f3 province in northern Chile, filed a legal complaint denouncing being the victim of fraudulent transactions carried out by Chilean senator Rafael Prohens.<\/p>\n<div class='d-flex justify-content-center d-xs-block d-sm-block d-md-none'>\n<div id='div-gpt-ad-1561499308230-0'><script>googletag.cmd.push(function() {googletag.display('div-gpt-ad-1561499308230-0');});<\/script><\/div>\n<\/div>\n<p>According to court documents obtained by local <a rel=\"noreferrer noopener\" aria-label=\"Radio B\u00edo B\u00edo (opens in a new tab)\" href=\"https:\/\/www.biobiochile.cl\/noticias\/nacional\/chile\/2019\/12\/27\/minera-presenta-querella-por-estafa-en-contra-del-senador-rn-rafael-prohens-por-us-27-millones.shtml\" >Radio B\u00edo B\u00edo<\/a>, in the $2.7-million legal complaint, Prohens is accused of taking part in a scheme that asked the company for excessive amounts of money to provide water to its operations. However, the resource was not properly supplied.\u00a0<\/p>\n<figure class=\"wp-block-pullquote alignright\">\n<blockquote>\n<p>Atacama Kozan is located in the Tierra Amarilla sector and produces around 52,800 tonnes of copper concentrate per year<\/p>\n<\/blockquote>\n<\/figure>\n<p>Instead, the company says that the money was used to finance the senator\u2019s 2017 political campaign, which helped him land his current post as a legislator in the Upper Chamber for the Atacama region.<\/p>\n<p>The complaint describes that it all started in 2014 when Atacama Kozan signed a contract with a farm called Agr\u00edcola Do\u00f1a Berta which was represented by Prohens and which was supposed to be in charge of supplying water to the mine at a price of $1.17+tax per cubic metre. A measuring device was to be installed at the intake so that it was clear how much water was being sold, but the mechanism was never set up. Yet, the miner continued to make payments to the farm.<\/p>\n<p>The court document states that since there wasn\u2019t a clear measure of how much water was being provided, there isn\u2019t a straight record of where the payments ended up.
