{"id":1143015,"date":"2019-10-09T13:01:51","date_gmt":"2019-10-09T18:01:51","guid":{"rendered":"https:\/\/www.mining.com\/?p=1003986"},"modified":"2019-10-09T13:01:51","modified_gmt":"2019-10-09T18:01:51","slug":"ucore-wins-favorable-decision-in-court-battle-with-acquisition-target-ibc","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1143015","title":{"rendered":"Ucore wins favorable decision in court battle with acquisition target IBC"},"content":{"rendered":"<p>Ucore Rare Metals (TSXV: UCU) <a rel=\"noreferrer noopener\" aria-label=\"has received a favorable decision (opens in a new tab)\" href=\"https:\/\/ucore.com\/n-s-appeal-court-decides-in-ucores-favour-ibc-must-file-defence-within-10-days\" >has received a favorable decision<\/a> from the Nova Scotia Court of Appeal (NSCA) over its ongoing legal dispute with IBC Advanced Technologies, the company announced Wednesday.<\/p>\n<div class='d-flex justify-content-center'>\n<div id='div-gpt-ad-1561499308230-0'><script>googletag.cmd.push(function() {googletag.display('div-gpt-ad-1561499308230-0');});<\/script><\/div>\n<\/div>\n<p>Legal proceedings in Nova Scotia began in December involving Ucore&#8217;s prospective acquisition of IBC, specifically the enforceability of the option to purchase agreement (OTP) and defamatory public comments made by IBC and its CEO Steven Izatt.<\/p>\n<p>On April 23, Ucore successfully opposed IBC\u2019s motion challenging the Nova Scotia courts\u2019 jurisdiction over the disputes. Then on June 19, IBC\u2019s appeal of that decision was heard by the NSCA. <\/p>\n<p>On Wednesday, the NSCA issued a decision dismissing IBC\u2019s appeal and confirming that IBC had, by its actions, submitted to have the amended claims heard in Nova Scotia, and that there is no other, more appropriate, forum for the parties\u2019 litigation for the amended claims. Additionally, Ucore was awarded its costs on the appeal to be paid by IBC.<\/p>\n<p>IBC has 10 days to submit its defence and counterclaims against the amended action.<\/p>\n<p>The appeal decision by the NSCA counts as another court ruling in favour of Ucore on its unchanging path towards the acquisition of IBC, said the Nova Scotia-based rare earths miner.<\/p>\n<p>The parties have also been engaged in legal battles in the state of Utah, where IBC claims to have jurisdiction\u00a0over specifics of its case against Ucore. The lawsuit filed by IBC earlier in January was recently <a rel=\"noreferrer noopener\" href=\"https:\/\/ucore.com\/utah-court-dismisses-ibc-complaint-against-ucore-2\" >dismissed by a Utah district court<\/a>.<\/p>\n<p>Ucore is currently focused on the development of its Bokan-Dotson Ridge rare earth project in Alaska, located on Prince of Wales Island \u2014 60 km southwest of Ketchikan and 140 km northwest of Prince Rupert, BC.
