{"id":1137058,"date":"2019-09-08T08:45:10","date_gmt":"2019-09-08T13:45:10","guid":{"rendered":"https:\/\/www.mining.com\/?p=1001369"},"modified":"2019-09-08T08:45:10","modified_gmt":"2019-09-08T13:45:10","slug":"african-miners-reviewing-legalities-around-tailings-dam-failures-expert","status":"publish","type":"post","link":"https:\/\/juniorminingnews.com\/?p=1137058","title":{"rendered":"African miners reviewing legalities around tailings dam failures \u2013 expert"},"content":{"rendered":"<p>Matthew Burnell, director of international law firm Herbert Smith Freehills, said this week that following the recent catastrophic tailings dam failures in Brazil, miners operating in southern Africa have increased the fiduciary assessments of the risk integrity of their company\u2019s exposure to dam incidents.<\/p>\n<div class='d-flex justify-content-center'>\n<div id='div-gpt-ad-1561499308230-0'><script>googletag.cmd.push(function() {googletag.display('div-gpt-ad-1561499308230-0');});<\/script><\/div>\n<\/div>\n<p>During a presentation at the Paydirt 2019 Africa Downunder mining conference in Perth,&nbsp; Burnell said that most firms are paying close attention to the legal issues surrounding past, present and future ownership and management of mine tailings facilities.<\/p>\n<figure class=\"wp-block-pullquote alignright\">\n<blockquote>\n<p>Herbert Smith Freehills says m<g class=\"gr_ gr_9 gr-alert gr_spell gr_inline_cards gr_disable_anim_appear ContextualSpelling ins-del multiReplace\" id=\"9\" data-gr-id=\"9\">iners<\/g> operating in southern Africa have increased the fiduciary assessments of the risk integrity of their company\u2019s exposure to dam incidents<\/p>\n<\/blockquote>\n<\/figure>\n<p>\u201cThere is a growing consolidation of the legal, corporate and social requirements that miners can now be expected to apply to the management of tailings dams regardless of whether they are current or former dam owners,\u201d the lawyer said. \u201cThis consolidation includes pulling together the legislative risks and possible opportunities to mitigate these risks in respect of existing and historical dams, contractual legacy claims, claims against subcontractors, what insurance provisions were or are in effect and their adequacy, indemnity agreements for directors and whether they are relevant or sufficient, and a revision and update of any existing emergency incident plans.\u201d<\/p>\n<p>According to the expert who leads the environmental practice of the firm\u2019s Johannesburg office, there is a heightened awareness of the limitations on some financial provisions, a situation that is leading to some revision of mine closure plans.<\/p>\n<p>In his view, such reviews should see better management in the case an incident took place, which means that streamlined mechanisms should be in place to notify stakeholders and activate immediate mitigation measures, long-term corrective measures for a failed dam and long-term monitoring and preventative measures.<\/p>\n<p>The awareness -he said- came at a time miners in Africa and across the world are also having to come to terms with emerging risks regarding the resilience of mines to climate change.&nbsp;<\/p>\n<p>The year 2019 started with the <a href=\"https:\/\/www.mining.com\/video-shows-exact-moment-vales-dam-collapsed\/\"  rel=\"noreferrer noopener\" aria-label=\"catastrophic collapse (opens in a new tab)\">catastrophic collapse<\/a> of Vale\u2019s (NYSE:VALE) C\u00f3rrego do Feij\u00e3o tailings dam.
